When do you need a will? And what can you cover in a codicil?

You do not need a will for everything you want to leave behind. Some things can also be arranged with a codicil. How does that work exactly?

 

What can you cover in a codicil?

With a codicil, you can assign specific items to someone. It must be part of household goods or clothing and be identifiable; so not your entire collection, but for example, a specific ring. You can also include your choice to be buried or cremated in a codicil, as well as your wish to donate your body to science.

 

What requires a will?

What you cannot cover in a codicil is the inheritance of money, collections, real estate, and for example, your car or bicycle. For that, you need to have a will drawn up by a notary.

 

How do you create a codicil?

It is very simple. It is a handwritten statement, stating that you leave this specific object to a particular person or organization. You sign it with your name, the place and date of signing, and your signature.

What is also important to realize is that there are legal limits on what someone can inherit tax-free. If you leave your nephew a walnut table worth 5,000 euros, he will have to pay 900 euros in inheritance tax*. You can prevent him from having to pay this by including in your codicil that the inheritance tax can be paid from your estate.

 

*A nephew inherits 2,000 euros tax-free and then pays 30% on an inheritance worth less than 128,000 euros.

 

How do you store a codicil?

You can keep the codicil at home. The downside is that it can easily get lost. The safest option is to leave the original with your notary and keep a copy at home. To execute the codicil, the original is always needed. Inform your executor or heirs that you have made a codicil.

How is your will settled after your death?

Did you have a will drawn up by the notary? Then the notary ensures that your will is registered with the Central Testament Register (CTR). After your death, your will can be requested from the CTR by any notary in the Netherlands at the request of an interested party.

 

The notary informs the heirs about the existence and content of the will.

 

In your will

Have you included YvYa in your will? Then the notary and/or the executor will inform YvYa of this after your death.

In the case of a legacy, we usually receive a fixed amount of money or a percentage of the estate. If YvYa is named as a beneficiary, we take over all your assets and debts. Or we share them with your other heirs. This includes real estate, household effects, cars, art, bank accounts, or securities.

 

YvYa ensures that your estate is settled very carefully:

 

  • real estate is always appraised before it is sold;
  • valuable household effects are appraised and auctioned if necessary;
  • shares are sold as quickly as possible because we do not want to take any financial risks;
  • what happens to emotional items depends on your personal wishes. These are described in a codicil.

 

How is your will settled?

Every estate is concluded with an account and accountability prepared by the notary or executor. This is an overview of all receipts and expenses from the date of death. After the account and accountability have been approved by us, we grant the executor 'release and discharge'. This means that the duties and obligations as executor have been completed and the estate has been settled.
